MIMU Terms and Conditions of Use

These Terms and Conditions of Use apply to all visitors, users, contributors, and all others who, for any reason, access or use the MIMU website and associated MIMU products and services.

The access and use of the MIMU website constitute agreement with the following Terms and Conditions of Use:

1.  

Role of the MIMU
     
1.1  
The Myanmar Information Management Unit, or MIMU, is a service offered by the Office of the United Nations Resident and Humanitarian Coordinator to support the information management needs and decision-making of humanitarian, development and peace-focused actors across Myanmar.
     
1.2  
MIMU safeguards the common data and information repository for development, humanitarian and peace-focused actors in Myanmar through gathering and compiling data from various sources on relevant sectors, countrywide, and making this information widely accessible to the wider group of stakeholders.
     
1.3  
The MIMU provides shared and easy access to data, reports, and other products gathered and generated by the MIMU itself as well as those compiled by a wide variety of other stakeholders, including the civil societies, United Nations agencies, local and international non-governmental organisations, Red Cross agencies and donors, for the purpose of humanitarian, development, and peace-focused activities.

2.  

Terms of Use of MIMU Products
     
2.1  
All MIMU products and those provided by other development, humanitarian and peace-focused actors and shared through the MIMU's website are available free of charge and cannot be sold or used for commercial purposes.
     
2.2  
With the exception of MIMU’s geospatial datasets, which require special written permission from MIMU Management, users may copy, freely duplicate, and further distribute materials on the site provided that they comply with these Terms and Conditions of Use in their entirety, that MIMU (or the original author where relevant) is clearly cited as the reference, and that copies of the materials are not sold or used for commercial purposes.
     
2.3  
The use of MIMU’s geospatial datasets in online platforms require special written and signed permission from the MIMU Management. Such permissions, where granted, shall be on a one-time non-exclusive basis. No written permission for use of such datasets, information, materials, or products shall be construed to be an admission of liability for its content.

3.  

User Agreement
     
3.1  
Users of the MIMU website and products, including MIMU provided datasets, commit not to use these products or datasets or the information contained therein to advertise or offer to sell any goods or services, or conduct or forward surveys, contests or chain letters.
     
3.2  
Entities or individuals with a claim of authorship or copyright on any materials on the MIMU website can request their withdrawal at any time by submitting a written request to [email protected] but may not opt out of these binding Terms and Conditions of Use.

4.  

Acknowledgement of the MIMU and its Sources
     
4.1  
The MIMU seeks to ensure that all authors and sources of any materials contained in, or referred to in the MIMU website, products, and applications are duly acknowledged based on the information made available in the materials themselves. Therefore, all users of this website and its applications commit to acknowledging the MIMU and all content sources when using and/or reproducing information obtained from the MIMU website, products and applications.
     
4.2  
Users will not alter or delete any author attributions, legal notices, proprietary designations, logos, labels, titles, or falsify the origin or source of any material that is provided to, or taken from, this website.

Linking to the MIMU Website or MIMU Products
     
5.1  
MIMU encourages sharing information in a responsible way, prioritizing copyright, the integrity of the data and up-to-date information. For this reason, MIMU encourages users who maintain an external website to include hyperlinks to http://themimu.info/ or any of its subsidiary pages, on that external site without having to ask prior permission subject to the following conditions:

These hyperlinks must not:

infringe MIMU’s rights, in particular relating to its logo, acronym and intellectual property rights;

be used for the promotion of any other organisation or company, or of any commercial products or services.
     
      
As a consequence,

Links to the MIMU website or MIMU products must appear clearly as such, i.e. with the complete and obvious MIMU URL;

Linking to the MIMU website or MIMU products must refrain from creating frames, or using other visual altering tools around the MIMU pages;

Once a link to the MIMU website or MIMU products has been created, it should be tested to ensure that it works and meets the above conditions. We would then appreciate being notified via [email protected]
     
5.2  
None of MIMU's datasets, including geospatial data, shall be embedded on any online platform or website without prior written permission from MIMU Management. Such permissions, where granted, shall be on a one-time non-exclusive basis. No written permission for use of such datasets, information, materials, or products shall be construed to be an admission of liability for its content.

Country or Area Designations
     
6.1  
The boundaries and names shown and designations used and the presentation of the material on MIMU do not imply the expression of any opinion whatsoever on the part of the United Nations concerning the legal status of any country, city or area, or of its authorities, or concerning the delimitation of its frontier or boundaries.

7.  

Accuracy and Currency of Data
     
7.1  
MIMU endeavors to keep its datasets, products and graphics up-to-date and correct, however these are dependent on available information. The United Nations and the MIMU make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the information, products, services, or related graphics for any purpose and will not be liable for any errors, omissions, or delays in this information or any losses, injuries, or damages arising from its display or use.
     
7.2  
Materials provided on this Site are provided “as is”, without warranty of any kind, either express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose and non-infringement.
     
7.3  
The MIMU periodically adds, changes, improves or updates the materials on this Site without notice. Under no circumstances shall the United Nations or the MIMU be liable for any loss, damage, liability or expense incurred or suffered that is claimed to have resulted from the use of this site, including, without limitation, any fault, error, omission, interruption or delay with respect thereto.

The MIMU periodically incorporates, without notice, revisions, updates and improvements to its products and database content according to the source availability but undertakes no obligation to do so.

Any further information about the quality or limitations of the data and metadata should be obtained from the organisation or department responsible for the source database.

8.  

Liability

Under no circumstances shall the MIMU, the United Nations nor its affiliates or any of their respective agents, employees, information providers or content providers, be liable to any user or anyone else for any inaccuracy, error, omission, interruption, deletion, defect, alteration of or use of any content herein, or for its timeliness or completeness, nor shall they be liable for any failure of performance, computer virus or communication line failure, regardless of cause, or for any damages resulting therefrom.
     
8.2  
Any reliance on MIMU datasets, products and graphics is strictly at the risk of the user. Under no circumstances, including but not limited to negligence, shall the United Nations or its affiliates be liable for any direct, indirect, incidental, special or consequential damages, even if the United Nations or MIMU has been advised of the possibility of such damages.
     
8.3  
The user specifically acknowledges and agrees that the United Nations and MIMU are not liable for any conduct of any other user.
     
8.4  
This Website may contain links and references to third-party web sites. The linked sites are not under the control of the MIMU, and the MIMU and the United Nations are not responsible for the content of any linked site or any link contained in a linked site. The MIMU provides these links only as a convenience, and the inclusion of a link or reference does not imply the endorsement of the linked site by the MIMU or the United Nations.

As a condition of use of this site and of MIMU products of all types, all users agree to indemnify the MIMU and the United Nations and its affiliates from and against any and all actions, claims, losses, damages, liabilities and expenses (including reasonable attorneys’ fees) arising out of the use of this site, including, without limitation, any claims alleging facts that if true would constitute a breach by the user of these Terms and Conditions of Use.

Prohibited Activities

This site is provided to support humanitarian, development and peace-focused activities in Myanmar; access or use of the site for any purpose other than that for which the site is made available is prohibited. The site may not be used in connection with any commercial endeavors or for commercial purposes.
As a user of the Site, you agree not to:

crop, alter, or modify materials from the Site in a way that contrasts with their original context or misrepresents their original purpose.

systematically retrieve data or other content from the site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from a duly authorised representative of the MIMU.

make any unauthorised use of the site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.

use the site to advertise or offer to sell goods and services.

circumvent, disable, or otherwise interfere with security-related features of the site, including features that prevent or restrict the use or copying of any content or enforce limitations on the use of the site and/or the content contained therein.

disparage, tarnish, or otherwise harm, in our opinion, MIMU and/or the site.

use the site in a manner inconsistent with any applicable laws or regulations.

Privacy Policy

This site uses cookies. User information gathered from cookie usage will not be shared with third parties and is used solely by the MIMU to increase the relevance and quality of the user experience.
     
10.2 
Certain website functions require user registration to enable users to periodically update the submitted information (i.e. Contact information, Assessment tracking, Job and Proposal uploads). Personal details obtained in this registration process are used only within the MIMU and for this designated purpose and are not published, licensed or disclosed to third parties. The MIMU, however, assumes no responsibility for the security of this information. MIMU reserves the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
     
10.3 
Certain MIMU products include the possibility for “restricted” information sharing whereby it shares only part of the information provided by user/relevant agency publicly. The MIMU treats such restricted information with full confidentiality and will share it only as agreed with the user prior to use.
     
10.4 
Certain information about users of this website, such as Internet Protocol (IP) addresses, details of downloads and navigation patterns through the website, the time spent, and other similar information will be stored on MIMU servers for monitoring purposes. These will not specifically identify the user.

11. 

General Provisions
     
11.1 
The MIMU reserves the right to deny in its sole discretion any user access to this website or any portion thereof without notice.
     
11.2 
No waiver by the MIMU of any provision of these Terms and Conditions of Use shall be binding except as set forth in writing and signed by its duly authorized representative. The MIMU reserves its exclusive right in its sole discretion to alter, limit or discontinue the MIMU website or any materials in any respect.
     
11.3 
The MIMU shall have no obligation to take the needs of any user into consideration in connection therewith. If the user is dissatisfied with any material on this website or with any of its Terms and Conditions of Use, the user’s sole and exclusive remedy is to discontinue using the site. Nothing herein shall constitute or be considered to be a limitation upon or a waiver of the privileges and immunities of the United Nations, which are specifically reserved.

These Terms and Conditions of Use may change at any time, please review them regularly. By continuing to use this site, you are expressing and acknowledging your acceptance of these changes.
