MIMU Terms and Conditions of use

These Terms and Conditions apply to all visitors, users, contributors, authors and others who access or use the MIMU Website and associated MIMU products and services for any reason.

By accessing or using the MIMU Website, you agree to be bound by the following Terms and Conditions.

1.  

Role of the MIMU
     
1.1  
The Myanmar Information Management Unit / MIMU is a service of the Office of the United Nations Resident and Humanitarian Coordinator to support the information management needs and decision-making of humanitarian, development and peace-focused actors across Myanmar. MIMU activities are currently supported by the Government of Canada.
     
1.2  
MIMU safeguards the common data and information repository for development, humanitarian and peace-focused actors in Myanmar through gathering and compiling data from various sources on relevant sectors, countrywide, and making this information accessible to the wider group of stakeholders.
     
1.3  
As such the MIMU provides easy access to data, reports and other products compiled and generated by the MIMU itself as well as those compiled by a wide variety of other stakeholders, including the Myanmar Government, United Nations agencies, local and international non-governmental organisations, Red Cross agencies, Donors, and the academic sector.

2.  

General provisions
     
2.1  
The MIMU reserves the right to deny in its sole discretion any User access to this website or any portion thereof without notice.
     
2.2  
No waiver by the MIMU of any provision of these Terms and Conditions shall be binding except as set forth in writing and signed by its duly authorized representative. The MIMU reserves its exclusive right in its sole discretion to alter, limit or discontinue the MIMU website or any Materials in any respect.
     
2.3  
The MIMU shall have no obligation to take the needs of any User into consideration in connection therewith. If the User is dissatisfied with any Material on this website or with any of its Terms and Conditions of Use, the User’s sole and exclusive remedy is to discontinue using the Space. Nothing herein shall constitute or be considered to be a limitation upon or a waiver of the privileges and immunities of the United Nations, which are specifically reserved.

3.  

Terms of Use of MIMU products
     
3.1  
All MIMU products and those of other development, humanitarian and peace-focused actors shared through the MIMU's website are available free of charge and cannot be sold or used for commercial purposes.
     
3.2  
Users may copy, freely duplicate and further distribute these products and datasets provided that MIMU (or the original author where relevant) is clearly cited as the reference and that copies of the material are not sold.    

4.  

Acknowledgement of the MIMU and its sources
     
4.1  
The MIMU seeks to ensure that all authors and sources of any materials contained in, or referred to, in the MIMU website, products and applications are duly acknowledged based on the information made available in the materials themselves.
     
4.2  
All Users of this website and its applications undertake to acknowledge the MIMU and all content sources when using and/or reproducing information obtained from the MIMU website, products and applications.
     
4.3  
Users will not delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded, or falsify the origin or source of software or other material contained in a file that is provided to, or taken from, this website.

5.  User Agreement
     
5.1  
Users of the MIMU website and products, including MIMU provided datasets, commit not to use these products or datasets or the information contained therein to advertise or offer to sell any goods or services, or conduct or forward surveys, contests or chain letters, or download any file posted by another User of a Forum that the User knows, or reasonably should know, cannot be legally distributed in such manner.
     
5.2  
Any entity or individual submitting Materials for publication through the MIMU is hereby deemed to accept these Terms and Conditions unless written notice requesting withdrawal of the materials has been received by the MIMU. Entities or individuals with a claim of authorship or copyright on any such Materials can request withdrawal of their materials at any time by submitting a written request to [email protected] but may not opt out of these binding Terms and Conditions.

Online Privacy Policy

This site uses cookies. User information gathered from cookie usage will not be shared with third parties and is used solely by the MIMU to increase the relevance and quality of the User experience.
     
6.2  
Certain website functions require User registration to enable Users to periodically update the submitted information (i.e. Contact information, Assessment tracking, Job and Proposal uploads). Personal details obtained in this registration process are used only within the MIMU and for this designated purpose and are not published, licensed or disclosed to third parties. The MIMU, however, assumes no responsibility for the security of this information. MIMU reserves the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
     
6.3  
Certain MIMU products include the possibility for “restricted” information sharing whereby it shares only part of the information provided by User/relevant agency publicly. The MIMU treats such restricted information with full confidentiality and will share it only as agreed with the User prior to use.
     
6.4  
Certain information about Users of this website, such as Internet protocol (IP) addresses, details of downloads and navigation patterns through the website, the time spent and other similar information will be stored on MIMU servers for monitoring purposes. These will not specifically identify the User.

7.  

Linking to the MIMU website or MIMU products
     
7.1  
MIMU encourages a User who maintains an external website to include hyperlinks to http://themimu.info/ or any of its subsidiary pages, on that external site without having to ask prior permission subject to the following conditions:
These hyperlinks must not:

infringe MIMU’s rights, in particular relating to its logo, acronym and intellectual property rights;
  ●  
be used for the promotion of any other Organisation or company, or of any commercial products or services.
As a consequence,
  ●  
Links to the MIMU website or MIMU products must appear clearly as such, i.e. with the complete and obvious MIMU URL;
  ●  
If you link to the MIMU website or MIMU products, you must refrain from creating frames, or using other visual altering tools around the MIMU pages;
  ●  
Once a link to the MIMU website or MIMU products has been created, it should be tested to ensure that it works and meets the above conditions. We would then appreciate being notified via [email protected]

Accuracy and Currency of Data

Materials provided on this Site are provided “as is”, without warranty of any kind, either express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose and non-infringement. The United Nations and the MIMU specifically do not make any warranties or representations as to the accuracy or completeness of any such Materials.

The MIMU periodically adds, changes, improves or updates the Materials on this Site without notice. Under no circumstances shall the United Nations or the MIMU be liable for any loss, damage, liability or expense incurred or suffered that is claimed to have resulted from the use of this Site, including, without limitation, any fault, error, omission, interruption or delay with respect thereto.

The MIMU periodically incorporates, without notice, revisions, updates and improvements to its products and database content according to the source availability but undertakes no obligation to do so.

Further information about the quality or limitations of the data and metadata should be obtained from the organisation or department responsible for the source database.

Country or Area Designations

The boundaries and names shown and designations used and the presentation of the material on MIMU do not imply the expression of any opinion whatsoever on the part of the United Nations concerning the legal status of any country, city or area, or of its authorities, or concerning the delimitation of its frontier or boundaries.

10.  

No liability in respect of use
     
10.1  
Under no circumstances shall the MIMU, the United Nations nor its affiliates or any of their respective agents, employees, information providers or content providers, be liable to any User or anyone else for any inaccuracy, error, omission, interruption, deletion, defect, alteration of or use of any content herein, or for its timeliness or completeness, nor shall they be liable for any failure of performance, computer virus or communication line failure, regardless of cause, or for any damages resulting therefrom.
     
10.2  
The use of this Site is at the User’s sole risk. Under no circumstances, including but not limited to negligence, shall the United Nations or its affiliates be liable for any direct, indirect, incidental, special or consequential damages, even if the United Nations or MIMU has been advised of the possibility of such damages.

The User specifically acknowledges and agrees that the United Nations and MIMU are not liable for any conduct of any User.

The linked sites are not under the control of the MIMU, and the MIMU and the United Nations are not responsible for the content of any linked site or any link contained in a linked site. The MIMU provides these links only as a convenience, and the inclusion of a link or reference does not imply the endorsement of the linked site by the MIMU or the United Nations.

Prohibited Activities

This Site is provided to support humanitarian, development and peace-focused activities in Myanmar. You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors or for commercial purposes.
As a User of the Site, you agree not to:

systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from a duly authorised representative of the MIMU.

make any unauthorized use of the Site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.

use the Site to advertise or offer to sell goods and services.

circumvent, disable, or otherwise interfere with security-related features of the Site, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Site and/or the Content contained therein.

disparage, tarnish, or otherwise harm, in our opinion, MIMU and/or the Site.

use the Site in a manner inconsistent with any applicable laws or regulations.
